Drug testing compliance in Irvington, New Jersey

Exploring clinical laboratory regulations and Medicaid fraud concerns

A clinical laboratory in Irvington, New Jersey, has been ordered to repay over $3 million to the state Medicaid program after an audit revealed significant violations of drug testing compliance regulations.

The New Jersey Office of the State Comptroller (OSC) conducted an audit of Sunrise Clinical Lab, located on Ball Street, covering the period from July 2017 to April 2021. The findings indicated that in 24% of the 183 drug testing cases reviewed, the laboratory billed Medicaid without obtaining the required physician signatures, a clear breach of clinical laboratory regulations.

Further investigation uncovered that in 44 instances, Sunrise failed to perform the drug tests ordered by physicians, potentially compromising patient care. Additionally, some doctors reported that their signatures were affixed to test orders by Sunrise employees without their direct involvement, raising serious concerns about Medicaid fraud.

Acting State Comptroller Shirley Nehmelu emphasized the importance of adherence to Medicaid rules, stating that laboratories accepting Medicaid payments must comply with established regulations designed to prevent fraud, waste, and abuse in clinical testing.

This case underscores the critical need for strict compliance with drug testing regulations to ensure the integrity of medical services and the protection of patient welfare.
